Do I need legal advice/representation?
Many people don't contact an attorney for advice until their circumstances require them to get advice. Some problems, challenges, and disruptions can be avoided by proper planning, contract drafting, legal advice, and analysis. Although fees are generally based on an hourly rate based on time invested in your representation and advising, some transactions and circumstances can be billed at a flat-fee rate, depending on the circumstances and attorney you are working with. 1) Do I need an attorney even if I am not in trouble and am not being sued? The best time for a business owner or individual in a real estate transaction or business transaction to use an attorney is often when they don't even realize they need one. Although the Thomsen & Nybeck law firm provides assistance in both transactional and litigation matters, be sure to contact us as far in advance of an issue as possible, so we can provide you with the most effective help.
2) Will I get billed for just talking to you? We may offer a “free consultation” by phone, depending on the circumstances. This allows us to learn more about you and your needs, to determine if we are able to help you or not. If we can help you, we typically require an up-front retainer and an engagement agreement that outlines our billing policies. Since our value is in the advice and time we provide to you, often we bill based on an hourly rate for time involved in your representation. This will typically include phone calls, emails, conferences, and time drafting/reviewing agreements or contracts, so the more prepared and clear you can be with facts, paperwork, and how we can help, the more efficient we can be with time. Some matters may be able to be estimated in terms of how much time will be involved. In these circumstances, we will discuss whether “flat-fee” billing may be an option.
3) What are your qualifications? Brad Boyd, attorney with the firm of Thomsen & Nybeck, PA, has a Juris Doctorate degree from the University of Minnesota Law School. He is licensed to practice law in Minnesota. Brad stays actively involved in the real estate and business communities as a legal advisor, speaker, and author.
